I understand this completely. I agree with it. I just don't think most people can think quickly enough to pull this off without a mistake, which can only make things worse.
I conceal carry and the state statutes say I have to notify the officer immediately and produce my permit and I.D. Yes, yes, I know it is not constitutional, but let's say I attempt to cover my rear with all the constitutional clarifications and I somehow slip and waive my rights, or the LEO just ignores them, and the court does too,...I am opening myself to even more trouble by carrying and not complying.
So do I suck up a traffic ticket, or risk having weapons charges brought against me?
If I had the confidence in my ability to assert my rights adequately, I would definitely do that. Actually, I have done that, when not carrying. I was not driving either, but I was asked for identification, and I declined, telling the officer, "no thanks, but I appreciate the offer." Another time, a detective asked me to meet with him and write an affidavit. I told him the exact same thing. It worked, and I was left alone.
