When the police pull you over....

........stop helping them!
Acknowledge you know the the police are behind you. Continue driving to a public place. Record the entire encounter.
Do not answer questions, do not ever agree you were speeding, do not produce Liscence, Registration or Insurance UNTIL you ask the officer.."Can producing these documents be used against me?"

By surrendering/complying with illegal requests, you are helping waive your 4th and 5th A rights.
The job of the police is to get you to unwittingly DO just that.

I understand this completely. I agree with it. I just don't think most people can think quickly enough to pull this off without a mistake, which can only make things worse.

I conceal carry and the state statutes say I have to notify the officer immediately and produce my permit and I.D. Yes, yes, I know it is not constitutional, but let's say I attempt to cover my rear with all the constitutional clarifications and I somehow slip and waive my rights, or the LEO just ignores them, and the court does too,...I am opening myself to even more trouble by carrying and not complying.

So do I suck up a traffic ticket, or risk having weapons charges brought against me?

If I had the confidence in my ability to assert my rights adequately, I would definitely do that. Actually, I have done that, when not carrying. I was not driving either, but I was asked for identification, and I declined, telling the officer, "no thanks, but I appreciate the offer." Another time, a detective asked me to meet with him and write an affidavit. I told him the exact same thing. It worked, and I was left alone.

I'm very sure this is a problem in a lot of places, and it depends a lot on one's age, race and "gender," but I've simply never experienced anything like this. I had a single "ticket" - driving a little too fast on a deserted desert road back in the good old "55" days. Paid it and forgot it. Later, I drove 300 to 400 miles a DAY for 14 years, all over southern Calif. and never even got "pulled over." No "accidents," no contact with police on the roadways. And I was no goody two-shoes about obeying the idiot "laws" either. No idea....

The "police" here where I live simply are not like that. In 10 years, I've seen exactly four cars/trucks "pulled over," and was a passenger two other times, both in South Dakota. A "warning" about excess speed in town was the only result both of those times... and the driver and I were both open carrying. No mention made of the guns, period.

So, I'd suggest folks not get too paranoid about this and evaluate their own situation and area carefully before making waves.  Just my two cents worth.

When I was in Ill, the state says that I have to state my name when pulled over by a LEO.
but I do not have to show the LEO anything until ask for it.
So I do not even undue the seatbelt until asked for the DL.
after that it is yes or no answers.
if asked to search the vehicle, it is always no.
I know they can do a "Terry" search of the inside were I was sitting, but anywhere else needs a warrant to look.
did not have to worry about the CC in ILL, because Ill did not have it then.

but if you tell them no, you can sure bet they will hold you longer while they try and think up some to use on you anyway.

All I know is that if you don't use your rights then you will lose your rights period.  You may be able to go along to get along now but one day nothing you do to go along will enable you to get along.

Got pulled over just the other day.  Before we got very far into it he realized he had pulled over the wrong red truck.  He apologized and that was that.

haha, so now they are pulling over people base on the color of the vehicle, not the Lic plate.

lol well the reason he gave was he was going in the opposite direction as me and the guy with an alleged  bad inspection sticker who was also driving a red truck.  I did see the cop driving the other way.  Apparently when the cop turned around he got confused and pulled over the wrong red truck.

Well....Kudos to the other guy! :laugh: He got away with not having to pay tribute for not adhering to some BS regulation.

Ye gads and little fishes. Thank goodness our benevolent masters don't (yet) impose this nonsense here. sigh And, somehow, we don't have any dangerous, massive vehicle failures. Sort of like the anti-gun folks can't believe that blood won't be running down the streets without their "control." Ignoring the fact that it never has where that "control" is mostly or completely absent.

yea, in Ill, you had to get a vehicle sticker each year, as well as get it inspected each year too, got to keep the greenes happy.
Oh and you need a sticker from what ever town/city you were living in too, for each vehicle you owned.

the state said that you could not have any vehicle unlicensed for more than a year, or it could be towed off your property and scraped.

 A Terry Stop is not applicable in the situation you described.
A terry stop, includes what used to be called "in hot pursuit"...during the suspicion of a crime. Driving erratically, leaving the scene of an accident, tearing away from a bank that's just been robbed.
 Sitting in your car does not grant a terry stop by police.

"A "Terry Stop" is a stop of a person by law enforcement officers based upon "reasonable suspicion" that a person may have been engaged in criminal activity, whereas an arrest requires "probable cause" that a suspect committed a criminal offense. The name comes from the standards established in a 1968 case, Terry v. Ohio."

And the probable cause can be that the LEO smells something funny from your car, while it does or not, it is a judgement call for the LEO to make.
And it can be made at anytime the LEO wants, when he/she has you pulled over.

but the LEO still needs a Warrant to search any place that is locked.
